    I own a half interest in My Family Medical, LLC as of September 6, 2005. There are several state and federal laws governing a situation where a doctor, or doctor's family member, owns a home health company and his patients need a product supplied by that company. The insurance your child has governs which laws apply: 

The following only applies to Dr. Matusic's patients.

Anyone else may use My Family Medical without restriction.

If you have ANY form of Medicaid or Medicare, this includes:
  • Carelink Medicaid
  • Unicare Medicaid
  • EPSDT
  • Consultec
  • PAS
  If you are Dr. Matusic's patient and do NOT have any form of Medicaid listed to the left:
  • According to federal law, your child MAY NOT receive a product from My Family Medical (that may be billed to Medicaid) regardless of who prescribed it.

  • This means that if another doctor in ABC Pediatrics, a doctor that Dr. Matusic referred you to, or even if a doctor unknown to Dr. Matusic prescribes a home health product, then My Family Medical may not supply that product, regardless of if Dr. Matusic had anything to do with the determination of need of that product or not.

  • The applicable law is a federal law in the Balanced Budget Act of 1997, also known as Stark legislation. (this government web site will provide the details, but there are hundreds of pages written about this legislation)

 

 
  • Your child MAY receive any product from My Family Medical, regardless of who prescribed it.

  • You will always have a choice of which home health company to use.

  • You should never feel under any obligation to choose My Family Medical.

  • Some products supplied by My Family Medical are stored at ABC Pediatrics as a convenience for those who choose My Family Medical to supply those products (examples: nebulizer and phototherapy blankets). Those products are billed by My Family Medicals, not ABC Pediatrics. We will make this clear to you if you ever need one of these products.

  • The applicable laws are found in the West Virginia Medical Practice Act. ( Board of Medicine web site, look under medical practice act)
